Terms and Conditions

Applicability of the Agreement:
This user agreement incorporates the terms and conditions for IFLYNOW Pvt Ltd (IFLYNOW) and its affiliates to provide services to the the User planning to book any product or service from the company, through its websites or any other medium, including sales persons, offices, call centers, advertisements and information campaigns.

User is Completely Aware of This Agreement
Users availing services from IFLYNOW Pvt Ltd and its other interface are aware and well-versed with the terms and conditions of this agreement. It covers all the essential transactions or provision of the services availed by IFLYNOW for different purposes. All rights and liabilities of the User and IFLYNOW regarding any services to be provided by IFLYNOW shall be limited to the extent of this agreement.
IFLYNOW, on its sole discretion, reserves the right to terminate the access to any or all of its websites, other sales channels and any type of services without prior notice for any reason.

Besides this agreement, other terms of service (TOS) specific to the services delivered and products offered by IFLYNOW are air tickets, hotels and holiday packages etc. These products and services provided by IFLYNOW shall be considered to be a part of this agreement and if there is any conflict between these terms and services and this agreement, the terms of this agreement will be valid. The User need to read and accept the applicable terms of service for any product/ services availed.
In addition, the Service Provider can also provide terms and guidelines that cover various features, operating rules and policies valid to each service, including flights, hotels and packages. The User should understand and agree with the guidelines, operating rules and policies of the service provider with whom the User chooses to deal.
Services offered by IFLYNOW to the Users provided on acceptance without making any change in all the terms, conditions and notices of this agreement and its terms of services applicable from time to time. For clearing the doubts, it is explained that user acknowledges and accepts this agreement and terms of services. If the User does not agree with any of its parts, they are not supposed to avail services of IFLYNOW.

Third Party Account Information
When User uses the Account Access service with IFLYNOW websites, he permits IFLYNOW and its agents to access third party sites, including banks and payment gateways for retrieving demanded information.

While registration, the User chooses a password and is responsible to maintain the privacy of the account, including the password.
The User is fully accountable for any activity occurring while using their password or account. It is the responsibility of the Users to notify IFLYNOW instantly in written on witnessing any unauthorized use of their account or any breach of security. IFLYNOW will not be answerable for any loss due to unauthorized use of his password or account, either with or without his awareness.

Fees Payment
IFLYNOW reserves the right to take listing fees for some fixed listings, and there is transaction fee of flight booking and booking of other products may have some transaction fees. IFLYNOW reserves the right to change the fees at a time interval, without notice.
The User should be fully accountable for all charges or fees rising out of the use of the services.
If reservation does not get confirm for any reason, your refund will be processed and you will be intimated for the same. We are not responsible to make other booking to compensate or replace the unconfirmed one. All further bookings will be considered as new transactions without any reference of previous unconfirmed reservation.
The User may request IFLYNOW for refund against the unused or ‘no show’ air or hotel booking for any reasons as soon as possible. Any related refunds will be processed as per the policies of Airlines, Hotels, Buses and ours. No refund will be made for any requests done after the 90 days and amount will be forfeited.

Confidentiality
Any information announced Confidential by IFLYNOW shall be maintained confidentially by its users and should not be disclosed to serve the purpose of this agreement and the obligations of both the user and company.

Contact Information
IFLYNOW sends booking confirmation, travel information, payment confirmation, cancellation, refund status and various other important details through SMS or by voice call on the number shared by the User while booking. We can also contact the User through call, SMS or email if User hasn’t finished the booking to know the reason for the same. The User has to be agreed on receiving such communications and IFLYNOW needed authorization of the User as per the guidelines of TRAI.
Being our registered customer, IFLYNOW is authorised to send you any future offer/coupons and discussions.

Responsibility of the User
IFLYNOW is only liable for any transaction done by the User through IFLYNOW and will not be answerable for screening, censoring or controlling the transactions, including legal and valid according to the User.
The User assures that they will stand by all such procedures and guidelines regarding the use of the services. The User also affirms to comply with all relevant laws and regulations as regards of the use of the services regarding the jurisdiction concerned for each transaction.
The User also confirms that he is of the legal age to agree upon this contract and is not banned from availing our services by the laws of India.

Advertisers on IFLYNOW or Linked Websites
IFLYNOW is not liable for any advertisements being displayed on any of its pages or on any outside links of other web pages. So, Users have to verify the accuracy of all the information prior to relying on any such information. IFLYNOW is not responsible for anything of the linked sites or updates on such sites.

Customer Feedback
The User knows that IFLYNOW wants to know about the experiences of clients while booking and utilizing our services. To enhance their travel experience, User authorizes IFLYNOW to contact them with various offers through direct mailers, e-mailers, phone calls, SMS and Whatsapp. If customer chooses not to be contacted, he can write at [email protected].

Proprietary Rights
IFLYNOW may provide the User various materials, magazines, pictures, graphics and videos to back advertisements or information. Unauthorized use of these materials will be treated as breach of our copyright policy and legal actions may be taken against the user.

Booking Policy
The total price displayed on the site includes all applicable government taxes.
In case of increase in the fare in the issuance of the Air ticket , due to airlines, miscalculation in amount due to server error and from the banks payment gateway issue then IFLYNOW reserves the right to cancel the ticket and forfeit the amount received as Cancellation Charges.
The difference of amount should be paid to Easy Trip Planners Ltd. after the communication from IFLYNOW to avoid any discomfort. You are required to pay the entire amount prior to the confirmation of your booking. To get any infant’s ticket issued, the age of infant must be below 2 yrs and make sure that they have valid proof-of-age documents when they re checking in, and remember that the infant must be accompanied by an adult at least 18 years old.
You can book no more than one infant per adult. To avail infant fares; the infant must be under 24 months of age throughout the entire itinerary that you’re booking. If the age of infant is 24 months or above then you need to book a separate booking as a child. To get any child ticket issued, the age of child must in between 2-12 years and make sure that they have valid proof-of-age documents when they re checking in, and remember that the child must be accompanied by an adult at least 18 years old All the tickets/bookings issued to the customer shall additionally be governed under the terms and conditions as laid out by the respective Airlines/Supplier.
Company is not responsible for any delay or cancellation of flights from airline’s end. If ticket is cancelled directly from the airlines web site , office or call centre , customer needs to inform IFLYNOW.in for the refund to be processed. Please note that IFLYNOW.in do not get any alert from airlines directly.
The Travel Products offered are subject to availability and can be withdrawn without notice by the Travel Provider. Travel Products may also change at any time in accordance with the terms and conditions you agree with the Third-Party Travel Provider.

When you make a booking, you must provide accurate and complete details of each traveller, and according to their passport or other identification document. It is your responsibility to ensure that all details of the booking are complete and correct for all passengers before proceeding. Some Third-Party Travel Providers will deny carriage if the traveller’s name varies from their booking and may cancel automatically if the traveller’s name is amended. We have no responsibility for any loss or damage arising from the incorrect entry of a traveller’s name or as a result of the Third-Party Travel Provider’s policies. It is your responsibility to ensure that all details of the booking are correct before proceeding. Travel Products are not guaranteed until payment has been made in full and documents have been processed.

Most airlines offer only electronic confirmation of your reservation, or ‘e-ticketing’, on certain routes. We cannot be held responsible if your e-ticket does not arrive due to an incorrect email address or your junk email settings. You must notify us immediately if you change your email address or contact telephone number after making a booking. It is your responsibility to advise us if you have not received your e-ticket confirmation.

Deposits

You will be required to pay an advisory service fees as deposit or deposits for your booking. In some instances, full payment is required at the time of booking. We will advise you of these payment requirements.

All deposits are non-refundable for changes of mind or cancellation by you (subject to your rights to a refund or other remedy under the Indian Consumer Law).

Deposits will be forfeited after 6 months if not utilized from the date of transaction.

Final Payment of balance due

a) Final payment is required no later than 12 hours from the time of making the booking, unless otherwise stated.       

b) Any failure by you to make payment of the Travel Product in full by the due date may result in your booking being cancelled and the forfeiture of any deposit you have made.

Currency

Unless otherwise stated, payments are in Indian Rupees.

All pricing is inclusive of goods and services taxes (GST), or other such value added taxes, where applicable. Other taxes may apply upon Check- in.

Changes in Price and Itineraries for Travel Products

Prices for Travel Products displayed on our Website or otherwise communicated to you are provided as an indicative guide only and may vary due to peak demand periods, changes in surcharges, fees or taxes or currency fluctuations.

You should check all prices for Travel Products with us before acquiring Booking & Advisory Services. The Price of the Travel Products is not fixed until you receive confirmation from us that your booking is confirmed.

In the event that the Travel Provider adds surcharges, fees or taxes in relation to your booking after you have booked your Travel Products with us, we will advise you of the proposed price increases. If you do not wish to incur the additional charges, you may cancel the Travel Product.

In case of an obvious error (including any error in electronic labelling, error in data entry, error of calculation or clerical error) resulting in the display of a price which has obviously been displayed by mistake, we reserve the right to cancel your reservation, even if it was automatically confirmed on our Website. You will be informed of this as soon as possible, to allow you to make a reservation at the correct price, if you wish to. In any case, you will not be entitled to claim compensation from us on the grounds of the cancellation or the related costs, if any, that have been incurred due to an erroneous reservation which has been cancelled subject to your rights under the Indian Consumer Law.

We reserve the right to cancel your booking in the event we have reasonable grounds to believe it is fraudulent. In such circumstances we will attempt to contact you using the email address you provided at the time of booking or your bank. In the event we are not able to contact you or your bank, we may cancel your booking with no liability whatsoever. In the unlikely event that your booking has to be cancelled, a full refund will be made of all monies previously paid to us to the person(s) who originally paid for the booking.

If a Third-Party Travel Provider changes any part of your booking for reasons beyond its control, for example, if a Third-Party Travel Provider changes its schedules, overbooks, or if there are any changes in applicable surcharges, fees or taxes, we will use our reasonable endeavours to notify you. If any such changes result in your Travel Product costing more or otherwise being materially different, then you may cancel the Travel Product and we will refund any monies already paid less any fees charged by us under these terms and conditions and by the Third-Party Travel Providers under the terms and conditions you agreed with them.

It is your responsibility to re-confirm all flight departure times with the relevant airline/s prior to departure. Whilst we will endeavour to send e-mail notification of any changes to the original itinerary, we will not be liable for any costs incurred as a result of passengers missing any flight due to your failure to check your itinerary prior to departure.


Flight Amendment & Cancellation Policy
Every booking made on IFLYNOW is subject to cancellation charges levied by the airline, which may vary with respect to flight and booking class.
IFLYNOW.in levies negligible amount of 500 INR + 18% GST per passenger/per sector for domestic and 1000 INR + 18% GST per passenger/per sector for international air tickets as cancellation service charges. Some bookings may be non-refundable as per the specific airline’s policy. Some bookings cannot be cancelled partially as per the specific airline’s policy.
Cancellations can be made online or offline through My booking section or by sending an email to IFLYNOW We assist you in making various amendments for bookings. In few cases, you need to contact the airline directly.
Amendment charges on IFLYNOW.in are subject to change as per the policy of the airline, which varies due to flight timings and booking class. To cancel the tickets within 24 Hrs of the journey, IFLYNOW recommends customer to contact directly to the Airlines and after that, send the cancellation request on our website for refunds. In case of direct cancellation through airlines, refunds will be given according to airlines charges along with our service charge as above mentioned. After flight departure & in case of No Show, we don’t entertain any cancellation request .In case of No-show the refund amount is entirely depends upon the airlines. IFLYNOW has nothing to do with the refund amount.
IFLYNOW will refund the same amount to the customer, which we receive from airlines in case of No-Show.

Cancellations

If you cancel your Travel Product, your right to a refund is subject to relevant Travel Provider T&Cs and any rights that you may have under the Indian Consumer Law. It is not within our power to decide whether you will be eligible for a refund for the cost of the Travel Product from the Travel Provider.

Cancellation and Refund can only be processed on filling the refund form on our website. No other medium is accepted to apply for refund.

Applicable only for iDeals: If you have booked our iDeals with more than one passenger, the bookings can only be cancelled as a whole booking. You will then have to cancel your group booking and then re-book your flights. The money that you have paid will be adjusted to the new bookings based on availability and price.

Fees

If you cancel you Travel Product, or amendments to your booking are otherwise required, we charge cancellation and amendment fees as per the Schedule of Fees. These fees reflect the work required to cancel the Travel Product and in the circumstances, reflects our best pre-estimate of the costs that we will incur managing this process. However, we will not charge a cancellation or amendment fee if you cancel or amend your booking due to a breach by us of our obligations to you or if the cancellation or amendment is required due to our error.

The Travel Provider may also charge cancellation and amendment fees in accordance with the relevant Travel Provider T&Cs. These fees will be in addition to the fees charged by Us. We are not liable to you for any cancellation fees, amendment fees or refusals made by the Travel Provider, subject to any rights you may have against us under the Indian Consumer Law.

We reserve the right to cancel your booking in the event we have reasonable grounds to believe it is fraudulent. In such circumstances, we will attempt to contact you using the email address you provided at the time of booking, or via your bank. In the event we are not able to contact you or your bank, we may cancel your booking with no liability whatsoever, subject to the relevant Travel Provider T&Cs, a full refund will be made of all the monies previously paid to us to the person(s) who originally paid for the booking(less any fees charged by us under these Booking T&Cs)

Refunds

Your entitlement to any refund will depend on the relevant Travel Provider T&Cs which will apply subject to any rights you may have under the Indian Consumer Law.

We strongly recommend that you read and understand these Booking T&Cs and all relevant Travel Provider T&Cs, before making the booking. Your booking may be non-refundable.

As you have booked through us, you should contact us in the first instance to discuss your rights and any request for a refund.

If your refund request is granted by the Travel Provider, the amount of refund will be the amount paid less and any fees charged by us and fees charged by the Travel Provider in accordance with the relevant Travel provider T&Cs.

If the Travel Provider is required to or otherwise agrees to provide you with a refund for the Travel Product, we will facilitate the refund between the Travel Provider and you. Once we have received the refund from the Travel Provider, we will pass it on to you as soon as practicable. Refund processing could take minimum six (6) months or more depending upon the Travel Provider.

No refund is provided on partially utilised tickets. Refunds due to medical reasons are very rarely given by the airlines as such Travel Insurance is highly recommended.

IFLYNOW shall only be liable to provide a refund to you to the extent that it actually receives a refund from the relevant Third Party Provider and to the extent that such a refund from the relevant Third Party Provider exceeds the IFLYNOW cancellation fees.

In a situation where an error is incurred by IFLYNOW then IFLYNOW shall only be liable to provide a refund to you to the extent of the value of the Travel Product that you have purchased from us (for example, you will only receive refund of the ticket value that you have purchased through us).

If you have a booking with us in relation to a Travel but you do not show up to check-in or otherwise do not avail yourself of the Travel Product, you will not be entitled to any refund from us, subject to any rights you may have under the Indian Consumer Law.


IFLYNOW will process the refund only after getting cancellation request/claim from the customer/travel agent/corporate company through my booking section or email.
Refund against the cancellation of air tickets will be credited directly in customers mode of payment after receiving the refund amount from the Airlines. IFLYNOW will process refund within 72 only after receiving it from the concerned Airlines/hotel/transporter/other suppliers.
Due to Banking Procedures, Refund in credit cards may take duration of 72 hours while it may take 7 days in case of net banking transactions

Refunds in cases where Airlines/Hotel is declared as Insolvent or Bankrupt
IFLYNOW shall not be liable to pay any refunds whatsoever in cases where the Airlines/Hotel closes its operations or declares itself as insolvent The customers or clients or agents shall not hold the IFLYNOW liable to pay the refunds as assured at the time of booking of ticket in cases where the Airlines/Hotel closes its operation or declares itself as insolvent.
On the basis of assurity given by airlines/hotels/suppliers, IFLYNOW may sometimes refund amount to the customer but IFLYNOW reserves the right to recover the refunded amount on event of Airlines/hotels getting shutted down/non-operational/bankrupt.

Liability

Liability of Agency and Limitation of Liability

Your legal rights in connection with our provision of Booking and Advisory Services are against us.

Subject to your rights under the Indian Consumer Law, we are not otherwise liable to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including specific, direct, indirect, consequential, economic loss, incidental damages, lost profits or savings or damages for disappointment) which is suffered directly or indirectly in connection with:

i) any failure or delay on the part of the Travel Provider or any third party in relation to the supply of Travel Products to you;

ii) any acts or omissions of Travel Providers or third parties in the course of supplying Travel Products (including any liability in contract, tort, or otherwise, for any direct, indirect consequential, economic loss, incidental damages, lost profits or savings or damages for disappointment);

iii) any technical errors, corruption of any data, unauthorized access to your personal data, inaccuracies in information supplied by third parties, or failure to complete bookings when that failure is due to circumstances beyond our control;

iv) use of (or inability to use) our website or any linked website;

v) disruption to our website;

vi) the delivery or non-delivery of the Travel Product or;

vii) any act or omission of Travel Providers or other third parties;

viii) disruption to our phone lines.

(c) Your rights with respect to a confirmed booking affected by an event of Force Majeure will be subject to the terms and conditions of the relevant Supplier.

Liability of Travel Provider

a) Your legal rights in connection with the provision of the Travel Product are against the Travel Provider.

b) You pay the Travel Provider (via us the agent) for providing the Travel Product to you. Once you have acquired Booking & Advisory Services from us, the Travel Provider will provide you with the Travel Product on the relevant Travel Provider TnCs.

c) The Travel Provider is the supplier of the Travel Products and is responsible for any express or implied guarantee in relation to the supply of Travel Products.

d) All information, including but not limited to representations that a Travel Provider makes on its brochures, relating to the Travel Provider or a Travel Product is provided by the Travel Providers or other independent third parties. We are not including the standard, class, or description of accommodation or service provided by Travel Providers.

e) Without limiting the disclaimer of liability in the previous paragraph, any obligation we have to you will be suspended during the time and to the extent that we are prevented from, or delayed in, complying with that obligation by an event of Force Majeure.

11.3 Authority

a) You are solely responsible for the suitability of any Travel Product that you purchase. We are not liable for any inconvenience caused or expense incurred as a result of any unsuitability of the Travel Product, subject to your rights under the Indian Consumer Law.

b) We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking (regardless of whether other travellers have made separate payments) and that person will bind all such travellers to these Booking T7Cc and to the other Travel Provider T&Cs.

Passports 

All departing passengers require a valid passport for international travel. This means the passport must be valid for a set minimum period beyond your travel dates (the required minimum period depends on the country you visit).  It is your responsibility to ensure that you have at least six (6) months validity on your passport from the date you return from your departure.

Please ensure you have a valid Passport well in advance of travel as either the airline staff or immigration authorities will not allow you to pass through customs and board your flight without this documentation.

It is your responsibility to ensure that you have the required documents including passports and visas, before travelling to a destination. It is your responsibility to check with the respective Embassy or Consulate of each country that you are travelling to as many destinations require visas for both Indian and non- Indian passport holders. We recommend that you log on to Explore eVisas (joinsherpa.com)  It is your responsibility to ensure that you have at least six (6) months validity on your passport from the date you return from your departure.

Visas 

A visa provides you with the authority as a non-citizen to travel to another country. Some countries will not allow you to enter without a visa, or in some cases, without proof of a return or onward electronic or paper ticket.

Please ensure you have a valid Visa (as applicable) for all the countries you are travelling to which require a visa well in advance of travel as either the airline staff or immigration authorities will not allow you to pass through customs and board your flight without this documentation.

Visas are obtained from the issuing authority in India, usually an embassy. Visa requirements vary by both country you are travelling to and the current citizenship you hold so please ensure you check well in advance of your travel dates to allow sufficient processing time as required by the embassy. If you have booked a one-way ticket please ensure you have checked with the Consulate of the country you are travelling to in order to ensure that you comply with their laws and regulations.

Personal and Non-Commercial Use Limitation
Information, images and others contents of IFLYNOW.in are its personal property and provided to you for your personal and non – commercial use only. You are not supposed to copy, distribute, modify, publish, transfer, or sell any of these creative properties.

Indemnification
The User agrees to indemnify that he shall be entirely answerable for the breach of any specific rules and regulations of country or general code of conduct for which IFLYNOW can’t be responsible.

Right to Refuse
IFLYNOW reserves the right to deny or refuse any order of customer without giving any reason. Any contract to deliver any service by IFLYNOW is not complete until full payment is made from the customer and accepted by us.
Without prejudice to the other remedies under this agreement, Terms of Services or under relevant law, IFLYNOW may bound the user’s activity and warn other users for their actions to terminate his registration or refuse to provide the access of the website if:
The user breaches this agreement, terms of services and the documents it integrates by reference;
IFLYNOW is not able to authenticate any information given by the user
IFLYNOW finds users’ actions violate any third party rights or applicable law.
In breach of this agreement, IFLYNOW reserves the right to recover any due amount by the user and take strict actions.

Right to Cancellation If Invalid Information Provided
The User has to provide valid information while requesting for any services under this agreement and any misrepresentation of facts may allow IFLYNOW prohibiting the users from availing the services from IFLYNOW.
If IFLYNOW discovers that the information provided by the User is incorrect or has been misrepresented by him, IFLYNOW reserves the clear right to take steps against the User without any prior information to the User. In such cases, IFLYNOW will not be liable for any loss or damage caused to the User as result of the cancellation of the booked services.

Explanation of Number and Gender
The terms and conditions apply on both the singular and plural form of the terms defined. The terms and conditions apply on both the males and females.

Severability
If any condition of this agreement is concluded to be unacceptable or unenforceable in whole or in part, unacceptability or unenforceability will append only to such condition or part of such conditions. Other parts of the provision and all other provisions of this Agreement will continue to remain valid and effective.

Relationship
Any of the terms of agreement, terms & conditions and right to use this website by the User or any other section IFLYNOW websites shall not be considered to create a partnership between the User and IFLYNOW.

Donation Refund
No refund will be done for the donation made online during the booking of flight tickets

Updating Information by IFLYNOW
User acknowledges that IFLYNOW provides the services with practical industry and care. It makes sure that User does not face any trouble. Yet, occasionally, inaccuracies or typographical errors can be seen and corrected immediately once IFLYNOW notices them. Changes are done occasionally and improvements are also done in IFLYNOW’s websites without giving any notice to the User. Any advice received can’t be looked for any kind of decisions.

Modification of the Terms of Use
IFLYNOW.in has complete right to change its ‘Terms & Conditions and Terms of Use’, at any point of time, without any prior notice. We advise our users to review the terms and conditions of the website whenever they are going to avail any of its services.

Jurisdiction
IFLYNOW specifically denies any implied warranties represented by the laws of any other jurisdiction or country except those where it has its head office. IFLYNOW finds itself to be subject to the jurisdiction of the courts of Delhi.

User Agreement
IFLYNOW.in is not responsible for any kind of oversight or not understanding the content of its pages and User particularly agrees that use of the services is at their own risk only. To a great level IFLYNOW only provides platform to different service providers for booking their services. It is not liable for any aspect of the standards of services offered by the service providers. In no circumstances, IFLYNOW will be liable for the services offered by the service provider.
